The court found that the company had no formal systems in place to address inappropriate behaviour just monthly town hall meetings, which the court deemed grossly inadequate.
The case stemmed from a worker’s complaint involving inappropriate comments and messages of a sexual nature, sent by a company director. WorkSafe Victoria charged the company under section 21 of the Occupational Health and Safety Act 2004, which outlines an employer’s duty to provide a safe working environment.
The court found Blisspell guilty of failing to:
Develop a clear policy on appropriate and inappropriate workplace behaviours, including sexual harassment.
Outline unacceptable behaviours and provide a clear reporting and response process.
Train managers, supervisors, and staff on how to identify, prevent, and respond to inappropriate conduct.
This wasn’t just a slap on the wrist. The court imposed a six-figure fine to send a strong message: employers must take psychosocial risks seriously. A lack of action is no longer acceptable and ignorance is no defence.
