The incident occurred because the company, Saveba Pty Ltd, did not have a detailed traffic management plan that covered all types of mobile plant, such as forklifts and pallet riders. Although the company had a "safe work procedure" in place, it lacked specific guidelines for the safe use of pallet riders, including the use of horns, direction of travel, right of way, and appropriate speeds.
The worker, employed through a labour-hire company, was injured when the ride-on pallet mover he was driving collided with another moving pallet rider. His foot was crushed between the two vehicles, leading to the amputation of his leg below the knee. The court found that the risk of injury from mobile plant was obvious and known to Saveba, but the company had poorly addressed the need for appropriate systems, training, and supervision.
Following the incident, Saveba took several measures to improve its workplace health and safety (WHS) systems. These included appointing a dedicated WHS manager, implementing new traffic management systems, leasing new pallet riders with additional safety features, and requiring all workers to complete WHS training modules. The company also updated its induction process and established a new company-wide WHS committee chaired by the CEO.
This case serves as a stark reminder of the importance of having a comprehensive traffic management plan that covers all aspects of mobile plant operation.
